Terms of Use

Chapter 1. General Rules

Article 1 (Purpose)

These terms and conditions shall be aimed at stipulating rights, obligations and responsibilities between the institution and the member who use the seafood export support service (hereinafter “the service”) provided by the following institution (hereinafter “the institution”).

Article 2 (Definition)

① The institution shall provide the service through “the seafood export support platform (hereinafter “the platform”) and in this case, the platform shall refer to the website belonging to the following table.

② “Member” shall refer to a person who agrees to these terms and conditions, applies for membership, receives an ID by getting approval from the institution and uses the service provided by the platform. The member shall be mainly divided into two types.
· Domestic Corporate Member : As a person who concludes a service contract with the institution to use the service provided by the platform, it shall refer to a business operator who has the authority to use the service provided by the platform.
· Overseas Buyer Member : As a person who has an overseas address and concludes a service contract with the institution to use the service provided by the platform, it shall refer to a business operator who has the authority to use some of the services provided by the platform such as searching for products, viewing, etc.

③ “Member ID” shall refer to a combination of letters and numbers selected by the member and approved by the institution in order to use the service and check his/her identification. Each member may have only one ID.

④ “Password” shall refer to a combination of letters, numbers, special characters, etc. selected by the member for identification and personal information protection.

⑤ The definition of terms not defined in this Article shall be applied as stipulated in Service Guidelines and relevant laws including 「ACT ON PROMOTION OF INFORMATION AND COMMUNICATIONS NETWORK UTILIZATION AND INFORMATION PROTECTION」 (hereinafter “Information and Communications Network Act”), etc.

Article 3 (Validity and Change of Terms and Conditions)

① The platform shall post the contents of these terms and conditions on the service home screen or disclose them to the users in other ways, and when a user who agrees to these terms and conditions applies for membership and becomes a member by getting approval from the institution, these terms and conditions shall take effect.

② The institution may change the terms and conditions by modifying or rewriting and posting the terms and conditions within a range not against relevant laws such as Information and Communications Network Act, etc., and in this case, the institution shall specify and post a reason for revision and an application date along with the current terms and conditions on the service home screen until a day before an application date from 7 days before an application date. However, if a change has a significant effect on the rights and obligations of the members, it shall be posted by providing a grace period of at least 30 days from an application date, and if members do not raise any objection within the posting period, they shall be considered to agree on the revision and the revised terms and conditions shall be applied. In this case, a member who does not agree on the revised terms and conditions may stop using the service and cancel the service contract pursuant to Article 16.

Article 4 (Regulations Other Than Terms and Conditions)

① The matters not stipulated in these terms and conditions shall be subject to Service Guidelines, etc. except as otherwise provided in other laws.

② If a relevant law such as Information and Communications Network Act, etc. conflicts with the contents of these terms and conditions, the relevant law shall prevail. Any part of these terms and conditions shall not be used to exempt the relevant law.

③ If necessary, the institution may determine and announce provisions which will be applied to a specific service (hereinafter “the separate terms and conditions”), and if a member agrees on the separate terms and conditions and uses a specific service, the separate terms and conditions shall prevail.

Chapter 2. Membership, etc.

Article 5 (Membership)

① A person who wants to use this service shall agree on these terms and conditions and the personal information processing policy, provide the platform with valid information necessary for membership, submit the information by clicking a membership button and apply for membership.

② In principle, the institution shall approve a membership application if it is valid pursuant to the provision in the previous Paragraph. However, for any of the following each item, the institution may not approve a membership application.

  1. If a membership applicant does not use his/her real name or uses others’ name
  2. If a membership applicant enters false information or there is any missing information, error, etc.
  3. If a membership applicant violates the contract conditions and relevant laws in a transaction relationship with the institution
  4. If a membership applicant hinders social peace and order or the traditional custom or applies for membership to hinder social peace and order or the traditional custom
  5. If a member who has been subject to sanctions from the institution such as suspension, etc. applies for membership again after voluntarily withdrawing his/her membership
  6. If membership requirements stipulated by the institution are not satisfied or if it is confirmed that a membership application is illegal or unfair or if it can not be approved due to reasons attributable to a membership applicant or if a person applies for membership in violation of regulations
  7. If it is deemed necessary based on the reasonable judgment of the institution

③ The service contract between the institution and the member according to membership registration shall take effect at the time when the approval of the institution is completed pursuant to Paragraph 2 and the relevant contents are sent to a membership applicant.

Article 6 (Management of ID, etc.)

① The member shall comply with the following matters for the safe management of his/her ID and password

  1. If you become aware that your ID and password are stolen or used by the third party without permission, you shall immediately change your password, notify it to the institution and follow the institution’s instructions.
  2. You shall check if you log out after using the service.
  3. You may not provide or disclose your ID and password to the third party or share, transfer or assign your ID and password without any reasonable reason, and if you violate it, the institution may suspend your ID.

② The member shall be responsible for all disadvantages including loss, damage, etc. caused by his/her failure to comply with the obligations in this Article and the institution shall not be responsible for this.

Chapter 3. Use of Service

Article 7 (Service Details)

① The institution shall provide the member with the following services. However, overseas buyer members may use only some of them.

  1. A service for providing seafood export support-related information
    · Online export support service
    · Service for providing product information
    · Service for providing export information
  2. Other works related to the provision of support project and event information, etc.

② The institution may change and provide service details in Paragraph 1 and in this case, the institution shall announce or notify a change, an application date, etc. in a way stipulated in Article 3 and Article 10.

Article 8 (Service Hours)

① The member may use the platform service 24 hours a day unless there is a technical issue.

② However, despite the previous Paragraph, the service may be suspended temporarily in case of the institution’s periodic system maintenance and reasons stipulated in Article 10.

③ The institution may set service hours differently per service scope and in this case, the institution shall announce or notify a change, an application date, etc. in a way stipulated in Article 3 and Article 10.

Article 9 (Membership Service, etc.)

① In principle, the platform shall provide information and services for all members who comply with these terms and conditions free of charge. However, considering the level of activity, etc., some services may be provided only for some members and in this regard, the institution shall announce or notify the relevant contents, an application date, etc. in a way stipulated in Article 3 and Article 10.

Article 10 (Notice to Members)

① If the institution gives a notice to the member, it shall deliver a notice via an e-mail, a text message (SMS), etc. which are pre-agreed and designated between the member and the platform.

② For a notice to an unspecified number of members, the institution may substitute it with a separate notice by posting it on the platform’s notice board, etc. for at least 1 week. However, any matter which has a significant influence regarding the member’s own transaction shall be notified separately.

Article 11 (Content to Provision of Personal Information, etc.)

① If the institution needs to provide the member’s personal information to the third party, it shall notify the member of the contents in the following each item and get consent (it shall be the same if a consented matter is changed).

  1. A person who receives personal information
  2. Purpose of using personal information by a person who receives personal information
  3. Items of personal information provided
  4. Period during which a person who receives personal information holds and uses personal information

② If the platform entrusts the third party with the work to handle the member’s personal information, it shall notify the member of the contents in the following each item and get consent (it shall be the same if a consented matter is changed). However, if it is required to fulfill the contract regarding the provision of services and is related to improving the convenience of the member, the platform shall omit procedures for notification and consent by giving a notice through the personal information processing policy in a way stipulated by relevant laws.

Article 12 (Service Suspension)

① For any of the following items, the institution may restrict or suspend all or part of the service.

  1. For unavoidable cases including the maintenance, replacement, extension, breakdown, malfunction, etc. of the information and communication equipment
  2. If there is a problem in providing the service due to force majeure reasons such as loss of communication, disk failure, system down, blackout, a sudden rush of service use, etc.
  3. If this service cannot be maintained for special circumstances such as the change, suspension, etc. of this service
  4. Other force majeure reasons such as natural disasters, the state of national emergency, etc.

② If the institution suspends the service pursuant to the previous Paragraph, it shall announce or notify it to the members in a way stipulated in Article 3 and Article 10. However, it shall not apply when advance announcement or notification is unavailable because the service is suspended for reasons beyond the control of the institution (or loss of communication, disk failure, system down, etc. not caused by the intention or negligence of the institution or the operator).

③ The institution shall not be responsible for loss or damage suffered by the member due to the restriction and (temporary) suspension of the platform service unless the loss or damage is caused by the institution's intentional or gross negligence.

Chapter 4. Obligations of Contracting Party

Article 13 (Obligations of Institution)

① The institution shall comply with laws related to service operation and maintenance including relevant laws, etc. and do its best to provide the sustainable and stable service as stipulated by these terms and conditions.

② The institution shall make efforts to protect the personal information of the members collected regarding the provision of the service as stipulated by relevant laws including Information and Communications Network Act, etc. and shall not provide, leak, transmit and distribute personal information to the third party without the consent of the member. However, for any of the following each item, the institution may provide the personal information of the member to the third party within a range permitted by the law.

  1. If it is requested to provide information from the investigation agency or other government agencies because the member violates relevant laws when using the service
  2. If it is required to perform the information protection work such as checking an illegal activity, etc. including the member’s violation of laws and these service terms and conditions
  3. If it wants to send information data for Korean seafood promotion to provide the service
  4. If it obtains the consent of the member
  5. If it is required by other laws

③ If the member files a complaint related to the service, the institution shall handle it promptly.

Article 14 (Obligations of Member)

① The member shall be responsible for managing his/her ID and password. The member shall not provide or disclose his/her ID and password to the third party or allow the third party to use his/her ID and password.

② The member shall provide his/her information and information related to his/her company in a designated form truthfully and accurately and if his/her information is changed, he/she shall reflect changed matters immediately by modifying member information. The member shall be responsible for all disadvantages such as loss, damage, etc. caused by a failure to modify his/her information and the institution shall not be responsible for this. However, some items required for service management such as an ID, etc. may not be modified.

③ The member shall comply with these terms and conditions and relevant laws.

④ The member shall not perform an act in the following each item.

  1. An act of copying, distributing or commercially using information obtained from the platform without the consent of the institution
  2. An act of providing a member ID, etc. to the third party other than the member or collecting, storing or disclosing other members’ personal information
  3. An act of infringing upon the rights of the institution or the third party including intellectual property rights, etc.
  4. An act of registering, distributing or linking computer virus-infected data which causes the malfunction of equipment related to the service, information destruction or confusion
  5. An act of hindering the smooth operation of the service or disrupting the stable operation of the service such as continuously transmitting advertising information without the consent of the receiver
  6. An act of hindering the sound use of the service such as transmitting or receiving an excessive amount of data or posting the same
  7. An act that may infringe upon the rights, honor, credit and other reasonable profits of the institution or other members
  8. Other illegal or unfair acts

Article 15 (Member’s Post)

① If it is determined that the member’s post falls under any one of the following each item, the institution may delete a relevant post or temporarily suspend the provision of the service for a relevant member.

  1. If it contains the content that violates the laws of the Republic of Korea
  2. If it infringes upon the rights of the third party such as personal information, copyright, intellectual property right, etc.
  3. If it is against public order and good morals or is obscene or vulgar
  4. If it slanders the third party or defames his/her reputation
  5. If a platform administrator admits its necessity, such as containing the improper content

② All civil and criminal liabilities including copyright infringement caused by posted images, texts and images (including attachments) shall be borne by the member who posted relevant materials, and the institution shall not be responsible for this.

③ If necessary, the platform may edit and move within this platform or use for nonprofit purposes the content posted by the member without prior notice by getting his/her prior consent.

Chapter 5. Others

Article 16 (Contract Cancellation)

① The member may require the institution to withdraw his/her membership by clicking a membership withdrawal button on the EDIT-‘Modify My Information’ page any time and cancel the service contract with the approval of the institution.

② For any one of the following items, the institution may restrict or suspend the membership or cancel the service contract.

  1. If the member violates an obligation in Article 5, Article 6 and Article 14 of these terms and conditions
  2. If the member registers a post that falls under matters described in Article 15 of these terms and conditions or tries or has tried a transaction against public order and traditional custom
  3. If the institution revises the contents of the terms and conditions for reasonable reasons such as a change in relevant laws or transaction conditions, the improvement of the service, etc. and asks for consent, but the member refuses it
  4. If the member does an act that harms public interest or is prohibited by these terms and conditions and laws while using the platform

Article 17 (Exemption from Responsibility)

① The institution shall not be responsible for any damage suffered by the member for the following reasons.

  1. If the service may not be provided due to natural disasters or force majeure equivalent thereto
  2. If the service may not be provided temporarily or permanently or delayed due to force majeure situations such as a failure in the information and communication facility, a sudden rush of transactions, loss of communication, etc.
  3. f the member leaks his/her ID, password, etc. to the third party due to his/her own mismanagement
  4. If damage is caused by the member’s error in computer operation or work processing, etc.
  5. If a force majeure reason beyond our control occurs such as a system failure that may occur without intentional or gross negligence in the process of managing, inspecting, repairing or replacing the equipment including a server, etc. or in the process of operating software, a system failure caused by the third party’s attack, the spread of a computer virus, etc. whose solution has not been developed yet by domestic and foreign renowned research institutes or security-related companies or other natural disasters, etc.
  6. If the member does not obtain profits expected from the service or suffers damage
  7. If the member suffers damage because he/she makes a judgment based on information or data posted on the platform
  8. If the member suffers damage because others collected personal information contained in the contents voluntarily disclosed or posted by him/her
  9. If a link to an external site or data beyond the control of the platform is posted on the platform and an error in data or information included therein causes damage
  10. If a dispute arises between members or between the member and the third party through the service

② The institution shall not be responsible for emotional distress suffered by the member while using the platform unless it intentionally neglects a problem with a malicious intent.

③ The institution shall not be responsible for loss and damage suffered by the member in relation to the service without the intentional or gross negligence of the institution.

Article 18 (Belonging of Copyright and Restriction on Use)

① The copyright and other intellectual property rights for works written by the institution shall belong to the institution.

② The member shall not use or allow the third party to use information whose intellectual property right belongs to the institution among the institution obtained by using the platform for profit-making purposes by means of reproduction, transmission, publication, distribution, broadcasting, or other methods without explicit prior consent.

Article 19 (Competent Court)

① If a dispute arises between the institution and the member regarding the use of the service, the institution and the member shall have a sincere consultation to solve a dispute.

② If a dispute is not settled despite a consultation in the previous Paragraph and a lawsuit is field, both parties shall decide Seoul District Court as an exclusive competent court.

③ For the interpretation of these terms and conditions and disputes between the institution and the member, the laws of the Republic of Korea shall apply.

Article 20 (Others)

All schedules and attachments of these terms and conditions shall be considered an integral part of these terms and conditions.

Supplementary Provision

(Enforcement Date) These terms and conditions shall take effect from 2025. 3. 10.

Prohibition of Unauthorized Collection of Email Addresses

We reject the unauthorized collection of e-mail addresses posted on this website by means of e-mail collection programs or other technical devices, using human resources, etc. Please note that violations of this will result in criminal penalties under the Information and Communication Network Act.

Private Policy

Korea Fisheries Association and National Federation of Fisheries Cooperatives (hereinafter collectively “the institution”) shall establish and disclose the personal information processing policy as follows in order to protect the personal information of information subjects and process complaints promptly and smoothly pursuant to relevant laws such as 「Personal Information Protection Act」 (hereinafter “Personal Information Protection Act”) and 「Act on Promotion of Information and Communications Network Utilization And Information Protection」 (hereinafter “Information and Communications Act”).

Article 1 (Purpose of Personal Information Processing)

The institution shall process personal information for the following purposes. The processed personal information shall not be used for purposes other than the following purposes and if the purpose of use is changed, the institution shall take necessary measures including obtaining separate consent pursuant to Article 18 of Personal Information Protection Act and relevant laws.

  1. Homepage Membership and Management
    The personal information shall be processed for purposes including checking if a user wants to apply for membership, identifying and authenticating a user according to the provision of membership services, maintaining and managing membership qualifications, preventing services from being used illegally, providing all kinds of notifications and handling complaints.
  2. Provision of Goods and Services
    The personal information shall be processed to provide services, send contacts and bills, provide the content, verify the identity and verify the age.
    1) Provide a service for sending information related to projects for pioneering a fishery product overseas market and fishery policy projects
    2) Apply for a project online and reserve a K-seafood media studio
    3) Apply for downloading the K-seafood archive content
    4) Have a video consultation between an exporter and a buyer for import and export businesses
  3. Preparation of Statistics and Reporting Materials
    The personal information shall be processed to compile consultation results with users (on-site visiting buyers), collect survey materials and prepare reporting materials.

Article 2 (Item of Personal Information Processed)

① The institution shall collect and use personal information according to the standards in the following each item to provide services.

Article 3 (Processing and Retention Period of Personal Information)

① The institution shall process and retain personal information within the retention and use period of personal information stipulated by the law or within the retention and use period of personal information agreed by information subjects when collecting personal information.

  1. Membership Registration and Management : Until membership withdrawal. However, for any of the following reasons, the institution shall retain personal information until a relevant reason is ended.
    1) If an investigation or a survey is ongoing due to the violation of relevant laws, until the end of a relevant investigation or survey
    2) If a claim-obligation relationship according to the use of the homepage remains, until the settlement of a relevant claim-obligation relationship
    3) Retain the support history for 5 years from the support time pursuant to Article 26-2 of Subsidy Management Act and Article 21 of National Subsidy Integrated Management Guidelines (the retention period may vary depending on relevant laws)
  2. Provision of Goods or Services : Until the completion of supplying goods and services and the completion of payment/settlement. However, for any of the following reasons, the institution shall retain personal information until a relevant period is ended.
    1) Records of transactions including display and advertisement, contract details, fulfillment, etc. pursuant to Article 6 of 「Act On The Consumer Protection In Electronic Commerce」

Article 4 (Processing of Pseudonymous Information)

The institution shall pseudonymize some of the collected personal information to avoid identifying a specific individual for preparing statistics and reporting materials and utilize the same as follows.

Article 5 (Provision of Personal Information to Third Party)

① The institution shall process the collected personal information only within a scope specified in Article 1 (Purpose of Personal Information Processing) and provide personal information to the third party only for cases falling under Article 17 and Article 18 of Personal Information Protection Act such as the consent of information subjects or the special provision of laws, etc..

② The institution shall provide personal information to the third party by obtaining the consent of information subjects as follows.

Article 6 (Entrustment of Personal Information Processing)

② The institution shall specify matters on responsibilities such as prohibition of personal information processing for purposes other than the performance of entrusted works, technical and administrative protective measures, restrictions on re-entrustment, management and supervision of a trustee, compensation for damages, etc. in a document such as a contract, etc. pursuant to Article 26 of Personal Information Protection Act when concluding an entrustment contract, and supervise whether a trustee safely processes personal information.

③ If the contents of entrusted works or a trustee is changed, the institution shall disclose it through this personal information processing policy without delay.

Article 7 (Reading of Personal Information, Refusal and Withdrawal of Consent, etc.)

① The information subject may exercise his/her right to request the reading, correction, deletion, suspension of processing, etc. of personal information against the institution at any time.

② The right pursuant to Paragraph 1 may be exercised via phone, email, etc. and the institution shall take measures without delay.

③ The right pursuant to Paragraph 1 may be exercised through the legal representative or agent of information subjects. In this case, the power of attorney shall be submitted.

④ For a request for the reading and suspension of processing of personal information, the right of information subjects may be restricted pursuant to Article 35, Paragraph 5 and Article 37, Paragraph 2 of Personal Information Protection Act. may be subject to restrictions on the rights of the data subject pursuant to Article 35, Paragraph 5 and Article 37, Paragraph 2 of the Personal Information Protection Act.

⑤ The correction and deletion of personal information may not be requested when personal information is specified as a collection target in other laws.

⑥ For a request for reading, correction and deletion and suspension of processing according to the right of information subjects, the institution shall check if a person who makes a request such as reading, etc. is an information subject or a legitimate agent.

Article 8 (Destruction of Personal Information)

① If personal information becomes unnecessary due to the expiration of the retention period of personal information, the achievement of a processing purpose, etc., the institution may destroy relevant personal information without delay.

② If personal information must be retained continuously pursuant to other laws although the retention period of personal information agreed by information subjects is expired or the purpose of processing is achieved, relevant personal information shall be transferred to a separate database (DB) or stored in a different storage location.

③ The procedures and method for destroying personal information shall be as follows.

  1. Destruction Procedures
    The institution shall select personal information for which a reason for destruction occurred and destroy personal information by obtaining the approval of the institution’s personal information protection manager.
  2. Destruction Method
    The institution shall destroy personal information recorded and stored in an electronic file format to prevent records from being recovered and destroy personal information recorded and stored in a paper document by shredding or incineration.

Article 9 (Measure For Ensuring Safety of Personal Information)

The institution shall take the following measures to ensure the safety of personal information.

① Establishment and Implementation of Internal Management Plan
The institution shall establish and implement its internal management plan pursuant to the standards for measures for ensuring the safety of personal information protection.

② Minimizing and Securing Personal Information Handler
The institution shall minimize the number of personal information handlers and give a separate password to access personal information.

③ Restriction on Access to Personal Information
The institution shall control the access to personal information through procedures for granting, changing and canceling the authority to access the database system that processes personal information.

④ Personal Information Encryption
Since a password for a member ID is encrypted, stored and managed, only the member shall know it and an administrator may not confirm it.

⑤ Prevention of Malicious Program, etc.
In order to prevent the personal information of members from being leaked or damaged by hacking or a computer virus, etc., the institution shall install the access control system to control unauthorized access from the outside and make efforts to have all possible technical devices for ensuring security in other systemic ways.

⑥ Prevention of Physical Access
The institution shall have a computer room, a data storage room, etc. separately and control access to them.

Article 10 (Matters on Installation, Operation and Refusal of Personal Information Automatic Collecting Device)

① The institution may use ‘cookies’ for storing and frequently retrieving usage information to provide users with separate customized services. In this process, the following personal information items may be automatically created and collected.
- IP address, cookie, MAC address, service usage history, visit history, poor usage history, etc.

②The cookies shall refer to a small amount of information sent by a server (http) used to operate the website to a user's computer browser and may also be stored on a user's PC hard disk.

  • a. Purpose of Using Cookies: The cookies shall be used to provide information optimized to users by identifying visit and usage patterns, popular search words, secure connection, etc. related to each service and website visited by users.
  • b. Installation, Operation and Refusal of Cookies : The user may refuse to store cookies via option settings in the menu of Tools>Internet Option>Personal Information at the top of the web browser.
  • c. If the user refuses to store cookies, he/she may have difficulty in using customized services.

Article 11 (Personal Information Protection Manager)

① The institution shall generally take charge of works related to personal information processing and designate a personal information protection manager as follows to provide remedies against damage and handle complaints from information subjects regarding personal information processing.

Article 13 (Change in Personal Information Processing Policy)

If the contents of this personal information processing policy are added, deleted and modified due to any change in laws, policies or security technologies, they shall be notified via the homepage home screen or notification [7] days before the enforcement date of changes.
